    The statute of limitations in Virginia for car accident injury cases is generally two years.  Two years is the time within which a lawsuit must be filed in order to pursue the claim.  If suit is not filed within two years, then you lose whatever rights you may have had to pursue the matter.

     

    There are some limited exceptions to this rule.  One of those exceptions is for infants, meaning people younger than 18 years old.  They generally have two years from their 18th birthday to file suit for injuries in a car accident.  However, there are some complications even with this exception to the rule as the parental claim for medical bills related to an infant’s injury in a car accident has to be pursued within five years of that accident.

    The main thing to remember is that you do not want to wait anywhere near the two year mark before hiring an attorney.  If you come to a busy plaintiff’s injury lawyer with only a few weeks or months left prior to the statute of limitations running, they may well decline to take your case because they do not want to have the risk of something going wrong in filing the claim in such a quick manner.
